Fort Myers Florida * Bank Short Sales * Ask The Right Questions Before Moving Forward !

Short Sale Suggestions by Joe Kendall, Broker Associate Realtor with Sandals Realty located in Fort Myers and Cape Coral Florida. I read now and then about people talking about Bank Short Sales about their frustrations or how uncomfortable they are in looking or waiting for a reply on a contract for a Bank Short Sale.

I would like to offer a few questions, I ask the Listing Agent before making an offer on a bank short sale listing.

(1) How far behind is the Seller on the mortgage payments? Many mortgage companies will not get serious about an offer unless the seller is atleast 4 months behind in the mortgage and the bank has already started the process for foreclosure proceedings. 

(2) Has the Seller submited all the required documents to the Lender? The lender will not even give the Listing Agent a reply with out all the sellers required documents. Some banks want the seller required documents and your offer submitted or all at one time. Just knowing the listing agent has a 100% complete package to the lender will speed up the process

 (3) What kind of discussions have you had with the Lender ? This question puts the listing agent on the spot and opens up discussions. If the listing agent is without a direct line to the assigned Loss Mitigation Officer to the file would in most cases result in a longer then normal reply on your offer.

(4)Dose the Seller have a First and a Second Mortgage,  Is the second  it with the same Lender? It takes more time to close a bank short sale with two mortgages and is even more difficult if it involves two different Lenders, the the chances of the deal are greatly reduced, yet some do close but expect a longer wait.

(5) Dose the Seller have PMI ( Private  Mortgage Insurance ) on this property?  Many times this comes out in the very end of settling the short sale , So ask it up front before making the offer. More often then not, the Investor that bought the insurance, will require a promissory note for the balance on his investment, before accepting to close the deal. Most of the time they will not remove their portion of the debt on the property, if the seller can not come to some type of terms on a cash or a payment plan, the mortgage will not be able to be released from the mortgage regardless of the contract price.  

I would suggest you, don't shy away from the bank short sales! Find a Realtor that has experience in purchasing and closing bank short sales. We just need to start these simply dicussions with the listing agent and the answers to these questions, will give a you a better understanding on the direction you should take as the home buyer.

Joe Kendall, Broker Associate with Sandals Realty writes, When the real estate market in southwest Florida started in downward swing in 2006 I knew I had to find a better way to find business on the web as active buyers and sellers that could sell was going to get thinner and thinner.

 In 2006 I went out and bought the book "blogging for dummies" and started a Real estate blog.Then I studied the "Social Networking Concept"

 I have to admit was not a writer in school and I wasn't very good in English, but I knew from everything I have studied, I needed to be able to be a marketing company for my product which is real estate. You see I look at my business as a Internet marketing company with a focus in technology and service and my product  is real estate. 

My interest grew from having one blog to having 3 blogs, many several social networking sites and continue everyday toward reaching out to possible clients or someones friends. Focusing on collecting people as followers on Twitter or Friends on Facebook. My Marketing success has been the driving force in selling real estate in the last 5 years in one of the toughest Real estate market in the country southwest Florida.

The last two years have been some of my best years in a 12 year career in real estate. Today I manage a real estate office, sell and list real estate with Home Buyers and Sellers. I teach Social Marketing and Blogging/ Networking to Realtors and local business and the future is wide open ! My mind set is simple, what you give in helping local business you will get in return. Sharing the experiences is always good thing and I believe you will always get rewarded by the quality I give out, indirectly comes back to me in many forms. The quality I will receive in return has been well worth the effort and in most parts I have been correct 90% of the time.

Southwest Florida Waterfront Property . Flood Insurance Notice.

Flood insurance expired at midnight Monday May 31, 2010.

 

Congress has a number of bills that would have extended the National Flood Insurance Program (NFIP) beyond it's pre-set deadline of Monday at midnight, but the National Association of REALTORS® (NAR) are stating this action is unlikely to take place. Because the government has not made it a priority

 

as of today  June 1st 2010 the government flood insurance program ( NFIP ) no longer has the statutory authority to issue new or renewal policies unless Congress reauthorizes the program. This does not affect existing policies, renewal policies within a 30-day grace period, or policies purchased prior to the program's lapse.

 

It will impact you if your are buying a waterfront home in a  flood-zone if you are relying on a mortgage to close your home purchase.

 

Options during a release of government coverage.

 

If you are buying a waterfront property you can "assume" the seller's existing flood insurance policy. For this to work, the seller must have coverage and be willing to transfer it. More info: flood insurance policy assumption

 

There are a few private companies that also offer flood insurance  Lloyd's of London, Chubb and AIG. However, these companies issue only a limited number of policies and without federal backing. You will have to call and ask about rates. I can provide you witha couple of sample address so you can get a idea of costs based on different locations.

 

Secondary lenders that purchase mortgages have their own guidelines on a flood insurance lapse. Please refer to your loan officer or banker for their most updated information regarding requirement to close a waterfront home in southwest Florida.

The city of Cape Coral Florida   offers some of the lowest prices on waterfront property in the state of Florida. Specially in Cape Coral where Foreclosures and Bank Short Sales have rolled back prices down to almost  10 years! Freshwater homes ( land locked with no access to the gulf of Mexico ) with waterways leading to man made lakes up to 6 miles long are selling many are selling starting around $125,000  and Gulf Access Pool Homes starting around $195,000 . The condition of the seawall is important to check many home buyers and agents do not check the condition of the seawall. The rain water should be flowing over top of the sea wall into the canal. Check to insure the water is not running behind the wall and underneath to the waterway. This will cause the seawall to weaken and crack. You should walk the entire edge of the sea wall where the yard meets the seawall. If there is already water running behind the wall you will notice the soil will be starting to wash away.Secondly you should look at the outside wall surface to insure there are no major cracks. Replacing a seawall can cost several thousands dollars. Repairing should be done right away after closing on the property.                       

 

                                                                                                        The Condition of the dock and boat lift. l personally look at every piling to insure there are no major cracks or "Pealing of wood" Stress cracks on pilings holding the metal supports for the boat lift will be located where the lift is bolted to the piling. I would operate the lift, if it has not been oiled in a while it will make a large noise. if it shakes I would have in inspected by a Marine Contractor and the bearings could be going and in need of replacement. ( I can give you a good reference of a Marine Contractor to give you a estimate of repairing or replacing the current lift. )

 

The Boating distance to the River and the Gulf of Mexico. We have over 300 miles of Gulf Access Waterfront in Cape Coral Florida. In some areas yes we do have a lot of water but during the dry season we have some canals that are hard to get a boat out to open water.

We have different bridge heights ( Boat clearance ) within the City of Cape Coral. There is a big difference in location regards to boating distance (time in boating travel) to the river and open waterway.  As a home buyer you should know how long it will take you to get out to open water and what size of boat would you be limited to buying from any homes location.

Joe Kendall Realtor with Sandals Realty writes: Before you buy a Bank  Owned or Bank Short Sale Golf Course Condo, you should decide how often your going to play and what type of "golf membership plan" best fits your needs ? There are many golf course communities to choose from but you can eliminate many by the choices offer at each course. This is why I suggest you know your options before you buy !

 I would suggest you understand the difference in the offerings before you start looking, as the golf fees should match your needs too! Here are the 3 basic types offered here.

(1) "Bundled Golf"  The purchase of a home in this style of development comes with an automatic membership in the private or semi-private course. There are no up front entry costs, but there are annual dues that you must pay. Each development handles there pro shop differently in regards to scheduling tee times, allowing more people equal access to the course for all its members.

(2) " Pay as you Play"  These communities are on or near public courses, the rates my vary during the year, these are public courses and they can be over crowded during peak season. Yet off season can be wide open during afternoon and evening hours with rates  around $25.00 to $30.00 with some courses offering discounts cards and coupons.

(3) " Private Clubs"  Homes in these developments do not include a membership in the country club. Residents desiring a membership must pay initiation fee, along with annual dues. the membership in most of these clubs limit there membership to 250-300 members. I would suggest scheduling a meeting with the sales manager for club you maybe interested in joining to get a copy of the rules, fees and a list of social offerings that is included with the membership. 

Buying a home with in a golfing community it is important that you visit the club house, talk with the staff, ask fellow golfers playing, how they like it there? and last of all Play the course for yourself and see! As your real estate partner would encourage you to experience the great golf and lifestyle here in southwest Florida!
