This past week I was out looking at bank owned homes in Cape Coral with clients, I was also reviewing a couple homes for out of town buyers and I just wanted to explain why you need a buyers agent when buying bank owned REO Property. Bank owned property is sold in "as is " in "where is" terms. Meaning the seller is selling it in as is condition and makes no warranty to its condition.

 Many Realtors that sell Bank Owned property have property management companies that go to the bank owned property and change the locks and take pictures for the listing. The listing agent of the bank owned property sometimes do not always visit the property and lists the home off the taxes records in as is where is condition.

Remember the Listing agent has a contract with the seller to work in the best interest of the seller. Now not all Realtors, do this, but there are many companies that do.  Last week, I found these errors in the listing information sheet. 

After inspecting these homes with the home buyers here is what we found.

(1) This home was listed as having city water ( the inspection of the home showed this home was currently on well water )

(2) This home was found to be on city water with an association fee of 360.00 per year for the water service. ( This home was listed as a home with a well with future assessments coming )

(3)  This listing is a waterfront pool home on a freshwater lake. I called the listing agent and asked about a seawall? before going out to visit the property, the agent said I am not sure, I think so? We went to the property and the home was on a fresh water lake without a seawall. Not good for my homes buyers with two small dogs.

(4)  The listing advertisement stated the home just needed a little TLC . When we arrived at the home it had been neglected to the point of needed major remodeling. Yet in most cases, it is in the buyer eyes to TLC or what is major work. Every Home buyers eyes are different but I think everyone would of agreed on this one. 

When buying bank owned property, it is very important to review all the known facts about the property before making an offer on a property.

•6- Is the property on a main canal for boat traffic? What is access to a main canal?

•7- Fresh water home? Then what is the water level? How far can I travel in a boat?

•8- View? Can I buy interesting canal, better water view for the same money?

•9- Where can I see water from what rooms ? It's all about the View!

•10-What are the fishing possibly from my own dock? Yes some locations are better!

•11- How big of boat will fit on the lift? What is the weight limits on the boat lift?

There are lots of things to consider when buying waterfront real estate, Are choices here are great from canal from 80, 120,151,200 and 250 feet wide canals along with intersecting, end of a canal view and river views!

Now would you believe you would be able to get your best price and terms with some many people looking at the same time? 

I know when I take clients out to see say 8-to 10 homes  there is always 30% of the homes in any price range always look so much better then the rest. You know as well as I do many of the listings in that price range we picked to view a couple will be over priced for the value, a few will be under priced for the value. Well on this bus tour you don,t think the 10-15 people on this bus can.t see this too? And they are all reading body language as many like the same house you do but don,t want to lead on to others that they have interest.

I would suggest you talk to your Tax Account, a real estate Attorney and a Realtor that is experienced in closing bank short sales.  When you have decided that a bank short sale is the direction you would like to take to avoid foreclosure and having this on your personalized credit report for several years.

You should contact your lender and suggest to them that you would like to do a Bank Short Sale to avoid foreclosure.

You should request from your lender a Bank Short Sale Package from your lender. These days many of the banks have this information you can download from their web site or they can email or fax your the guidelines of their requirements.

  The Lender will advise you to get your home listed with a Realtor, price it where  the current market value for the home and bring them an offer. I suggest to you that you use a Realtor that is experienced in doing Bank Short Sales.  I work with several title Companies that provide the services I need to get the short sales accepted and closed!

The companies provide me with a pre-title work and a HUD-1 statement to present to the Lender . These are very important in the process of getting a Bank short sale, foreclosure Property or even a bank owned property to the closing table. In real easy to understand terms, the title search provides a list of any liens on the property, the Hud-1 statement provides the lender with all the fees involved in closing the transaction. I do not charge any fees to the seller for my loss mitigation services my fees are all payed by the sellers bank at closing.

Foreclosure can be avoided by doing a Bank Approved Short Sale. It is costly for banks to foreclose on your home. They do not want to own your home. You have options, allow me to explain the complete process to you today! You should do everything in your power to avoid Foreclosure.
